These terms and conditions have been elaborated pursuant to the Civil Code, the Consumer Protection Act and the Electronic Commerce Act, as amended.
These terms and conditions govern the rights and obligations of the parties arising from the purchase contract concluded between the seller, which is Motard sro, registered office Majerská 137/18, 911 01, Trenčín IČO: 46154531, IČ DPH: SK2023262054, registered in the Commercial Register maintained by the Trenčín District Court, Section: Ltd., Insert No .: 24499 / R, Tax ID: 2023262054 (hereinafter referred to as "Seller") and Buyer, whose subject matter is the purchase and sale of goods on the Seller's e-commerce website.
The parties agree that by sending an order to the seller, the buyer confirms its agreement that these terms and conditions will apply to any purchase contract concluded through the seller's website, based on which the seller delivers the goods presented on the website to the buyer (hereinafter referred to as "Purchase Agreement") and any relationship between the Seller and the Buyer arising from the conclusion of the Purchase Agreement.
These General Terms and Conditions form an integral part of the purchase contract.
The list of goods on the e-commerce website operated by the seller is a catalog of commonly supplied goods and the seller does not guarantee the immediate availability of all the goods listed. The availability of the goods is indicated in the picture of each item in the item "Availability" and will be confirmed to the buyer based on the buyer's question.
The Seller is bound by the Buyer by its offer of goods presented on the Seller's website, including the price, within 24 hours of sending the notice of receipt of the order to the Buyer.
2. Method of concluding the purchase contract (order)
The purchase contract is concluded by creating a binding order on our online store www.motard-design.com or after the previous binding acceptance of the proposal to conclude a purchase contract by the seller in one of the following forms:
An email message from a buyer sent to the seller
the buyer filled out and sent the form on the seller's website,
by telephone order from the buyer to the seller.
Upon prior acceptance of the order, the Seller shall issue to the Buyer a confirmation, marked as "Order Confirmation", of acceptance of the order by mail or telephone. An automated notification of receipt of an order into the electronic system of the seller is not considered as acceptance of the order.
The order confirmation by the seller contains the following information:
availability and delivery date of the goods to the buyer,
name and price of goods, price of transport,
address of the place of delivery of the goods together with the contact person,
conditions and method of transport.
3. The rights and obligations of the seller
The seller is obliged to:
to deliver the goods in the agreed quantity, quality, and time to the buyer on the basis of an order confirmed by the seller and to pack it in the way necessary for its protection during transport,
to ensure that the delivered goods comply with the valid legal regulations of the Slovak Republic,
hand over the instructions in the Slovak language together with the goods to the buyer together with the goods in written form, the warranty card, the delivery note and the tax document.
The Seller has the right to a proper and timely payment of the purchase price from the Buyer for the delivered goods.
4. Buyer's rights and obligations
The buyer is obliged to:
take over purchased or ordered goods,
pay the seller the agreed purchase price within the agreed maturity, including delivery costs,
confirm the receipt of the goods in the delivery note by his signature or the signature of a person authorized by him,
do not damage the good business name of the seller.
The Buyer has the right to deliver the goods in the quantity, quality, time and place agreed by the parties in the order confirmation.
5. Delivery and payment terms
The goods are sold according to the exhibited samples, catalogs, type sheets and samplers of the seller placed on the seller's e-shop website: www.motard-design.com
The seller is obliged to fulfill the buyer's order and deliver the goods to the buyer within 7 working days from the delivery of goods by the supplier or the producer of the goods to the seller.
If a customer orders a larger quantity of goods, they will be delivered on a one-time basis and their delivery time will correspond to the product with the longest delivery time (example - if you order three products with delivery time of 5 and 10 days) (10 days). The Operator undertakes to notify the Customer by e-mail at the latest within 24 hours (within working days) of receipt of the order, whether the order is being processed or waiting for the ordered goods from the Supplier.
The Buyer is obliged to take over the goods at the place specified in the Buyer's order confirmation by the Seller. In the event of delay in delivery of the goods by the seller, the seller is entitled to unilaterally extend the period for delivery of goods, even repeatedly, which the seller issues the buyer
