Instructions on exercising the consumer’s right to withdraw from a distance contract and

a contract concluded outside the trader’s premises

 

1. Right to withdraw from the contract

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you or a third party other than the carrier and indicated by you acquires possession of the goods.

When exercising your right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement:

  • you can send the completed withdrawal form together with the goods by post to the address,
  • or send the withdrawal form, or any other clear statement of withdrawal from the contract, by e-mail to: info@motard-design.com,
  • or via the online interface, submit a withdrawal request directly from the site.

Withdraw from the contract online

You can also withdraw from the contract via the online interface using the withdrawal function. The withdrawal function can be found at https://motard-design.com/odstupenie-od-zmluvy/.

If you use this option, we will confirm receipt of your withdrawal by e-mail without delay.

The withdrawal period is maintained if you send a notification of the exercise of the right of withdrawal before the withdrawal period expires.

2. Consequences of withdrawal from the contract

After withdrawal from the contract, we will refund all payments that you have made in connection with the conclusion of the contract, including the costs of delivering the goods to you. This does not apply to additional costs if you have chosen a type of delivery other than the cheapest standard delivery method offered by us.

Payments will be refunded to you no later than 14 days from the day on which we receive your notification of withdrawal from this contract. Reimbursement will be made using the same method of payment as you used for your payment, unless you have expressly agreed to a different method of payment, without charging any additional fees.
We may delay the refund until you return the goods to our address or until you provide proof that you have sent the goods back, whichever is the earlier.
You must return the goods to us no later than 14 days from the day on which you exercise your right of withdrawal. The period is considered to have been met if you send the goods back before the 14-day period has expired.

You will bear the direct costs of returning the goods: the estimated cost is 5 euros.

Liability for damage to returned goods: You are only liable for any diminished value of the goods resulting from handling them in a manner other than that necessary to establish the nature, characteristics and functionality of the goods.

 

 

Poučenie o uplatnení práva spotrebiteľa na odstúpenie od zmluvy uzavretej na diaľku a zmluvy uzavretej mimo prevádzkových priestorov obchodníka

 

1. Právo na odstúpenie od zmluvy

Máte právo odstúpiť od tejto zmluvy bez uvedenia dôvodu v lehote 14 dní.

Lehota na odstúpenie od zmluvy uplynie po 14 dňoch odo dňa, keď Vy alebo Vami určená tretia osoba okrem dopravcu prevezmete tovar.

Pri uplatnení práva na odstúpenie od zmluvy nás informujte o svojom rozhodnutí odstúpiť od tejto zmluvy jednoznačným vyhlásením:

  • vyplnený formulár o odstúpení od zmluvy spolu s tovarom môžete zaslať poštou na adresu,
  • alebo formulár na odstúpenie od zmluvy, resp. akékoľvek iné jednoznačné vyhlásenie o odstúpení od zmluvy poslať e-mailom na: info@motard-design.com,
  • alebo prostredníctvom online rozhrania odoslať požiadavku na odstúpenie priamo zo stránky.

Ak využijete túto možnosť, prijatie odstúpenia od zmluvy Vám bezodkladne potvrdíme e-mailom.

Lehota na odstúpenie od zmluvy je zachovaná, ak zašlete oznámenie o uplatnení práva na odstúpenie od zmluvy pred tým, ako uplynie lehota na odstúpenie od zmluvy.

2. Dôsledky odstúpenia od zmluvy

Po odstúpení od zmluvy Vám vrátime všetky platby, ktoré ste uhradili v súvislosti s uzavretím zmluvy, vrátane nákladov na doručenie tovaru k Vám. To sa nevzťahuje na dodatočné náklady, ak ste si zvolili iný druh doručenia, ako je najlacnejší bežný spôsob doručenia, ktorý ponúkame.

Platby Vám budú vrátené najneskôr do 14 dní odo dňa, keď nám bude doručené Vaše oznámenie o odstúpení od tejto zmluvy. Úhrada bude uskutočnená rovnakým spôsobom, aký ste použili pri Vašej platbe, ak ste výslovne nesúhlasili s iným spôsobom úhrady, a to bez účtovania akýchkoľvek ďalších poplatkov.

S vrátením platby môžeme čakať do vrátenia tovaru späť na našu adresu alebo do preukázania, že ste tovar odoslali späť, podľa toho, čo nastane skôr.

Zašlite nám tovar späť najneskôr do 14 dní odo dňa uplatnenia práva na odstúpenie od zmluvy. Lehota sa považuje za zachovanú, ak tovar odošlete späť pred uplynutím 14-dňovej lehoty.

Priame náklady na vrátenie tovaru znášate Vy. Predpokladaný odhad týchto nákladov je 5,- eur.

Zodpovednosť za škodu vzniknutú na vrátenom tovare: Zodpovedáte len za akékoľvek zníženie hodnoty tovaru v dôsledku zaobchádzania s ním iným spôsobom, aký je potrebný na zistenie povahy, vlastností a funkčnosti tovaru.
