Price of goods<\/span><\/span><\/span><\/h2>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">2.1 The trader is a VAT payer.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">2.2 All prices for goods and services and all fees in the online store are stated including the applicable VAT rate.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">2.3 The price for shipping the goods is added to the basic price of the goods, depending on the delivery method chosen by the consumer.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Packaging is included in the shipping price.<\/span><\/span><\/span><\/p>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz JpY6Fd\"><span class=\"ryNqvb\">3. Ordering goods<\/span><\/span><\/span><\/h2>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">3.1 The consumer can order goods via the shopping cart at<\/span><\/span><\/span>\u00a0<a href=\"https:\/\/motard-design.com\" target=\"_blank\" rel=\"noopener\">https:\/\/motard-design.com<\/a><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">3.2 After sending the order, your order will be processed and a confirmation of receipt of the order will be delivered to your e-mail.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">By sending the order, the buyer confirms to the trader that the trader has timely and properly fulfilled its information obligations pursuant to the provisions of Section 15, paragraph 1 of Act No. 108\/2024 Coll.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">on consumer protection in the sale of goods or the provision of services based on a distance contract or a contract concluded outside the seller&#8217;s business premises and on amendments to certain acts (hereinafter referred to as the &#8220;Consumer Protection Act in the Sale of Goods&#8221;).<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If necessary, all further information regarding your order will be sent to the e-mail address you provided.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">3.3 By sending the order, the consumer undertakes to take over the ordered goods and pay the agreed price for the goods.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">3.4 The trader undertakes to deliver the correct type and quantity of goods at the agreed price according to the order.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz\"><span class=\"ryNqvb\">3.5 The trader has the right to cancel the order if it is not possible to provide the ordered goods.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">In such a case, the trader will immediately refund the consumer the amount paid in full or offer him\/her replacement goods or another solution, if the consumer agrees.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader also has the right to cancel the order if he\/she cannot contact the consumer (incorrectly provided or missing contact details, unavailability, &#8230;).<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">3.6 By sending the order, the consumer confirms that the trader has timely and properly fulfilled his\/her information obligations pursuant to the provisions of Section 15, paragraph 1 of the Act on Consumer Protection in the Sale of Goods or Provision of Services Based on a Distance Contract or a Contract Concluded Outside the Seller&#8217;s Business Premises and on Amendments to Certain Acts.<\/span><\/span><\/span><\/p>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4. Payment and delivery terms<\/span><\/span><\/span><\/h2>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.1 The consumer can pay for the goods by credit card via the Stripe payment gateway, Paypal or by transfer to the merchant&#8217;s bank account.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.2 Payment is only possible in EUR.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.3 We deliver the goods worldwide.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.4 The tax document (invoice) is sent to the consumer by e-mail by the merchant.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.5 The delivery time for the goods on offer is in most cases within 24 hours of order confirmation, the usual delivery time is 4 to 7 days in the case of custom-made production or a maximum of 14 days in cases of unavailability of the goods in the merchant&#8217;s warehouse.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The delivery time may be extended in cases of longer unavailability of the goods by agreement with the consumer.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The merchant will inform the consumer about the extended delivery time and delivery date when confirming the order by phone or e-mail.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If the consumer is not satisfied with the announced extended delivery period, he has the option to cancel the order or withdraw from the contract according to point 5 of these terms and conditions.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.6 The trader will inform the consumer about the dispatch\/expedition of the goods by e-mail.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.7 The trader provides transport of the goods worldwide.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">When placing an order, the consumer chooses the carrier\/method of delivery of the goods by selecting from the offer when placing the order on the online store https:\/\/motard-design.com The trader provides the following delivery options: <\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">a) by courier service &#8211; the consumer chooses the courier company when placing the order at the checkout<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">b) personal collection<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Address for personal collection of goods: Motard Design s.r.o., Majersk\u00e1 137\/18, Tren\u010d\u00edn 911 05, Slovakia <\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The price for transporting the goods to the specified location is calculated for the consumer and displayed in the order summary at the checkout.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The usual transport prices are listed in the points below.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Order via Packet up to 2kg \u2013 7.90 EUR<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Personal collection &#8211; free of charge (The order can only be paid for by cashless payment)<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.8 The collection place is determined based on the data entered for delivery in the order.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Delivery of the goods to the specified location is considered to be completed.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.9 The goods are appropriately packaged and secured.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer is obliged to check the integrity of the shipment when receiving the goods and not accept the shipment from the delivery person in case of damage.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">This way, both the consumer and the trader will avoid unnecessary costs for any possible complaint about the goods.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.10 Together with the goods, the trader will provide the consumer with an invoice (tax document).<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The invoice also serves as a delivery note and a warranty certificate.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">4.11 The trader is responsible for the goods only after they have been received by the consumer.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The goods are deemed to have been received by the consumer at the moment when the consumer or a third party designated by him, with the exception of the carrier, takes over all parts of the ordered goods, or if: <\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">a) the goods ordered by the consumer in one order are delivered separately, at the moment of taking over the goods that were delivered last,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">b) the goods consisting of several parts or pieces are delivered, at the moment of taking over the last part or last piece,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\">c) tovar dod\u00e1va opakovane po\u010das vymedzen\u00e9ho obdobia, okamihom prevzatia prv\u00e9ho dodan\u00e9ho tovaru.<\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">c) the goods are delivered repeatedly during a defined period, at the moment of taking over the first delivered goods.<\/span><\/span><\/span><\/p>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">5. Right to withdraw from the contract and exercise of the right to withdraw from the contract concluded remotely via the online interface.<\/span><\/span><\/span><\/h2>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">5.1 In accordance with Act 108\/2024, Section 19, Paragraph 1, the consumer is entitled to withdraw from the completed order (according to the Act \u201cfrom the purchase contract\u201d) without giving a reason, within the following period:<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">within 14 days from the date of receipt of the goods.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">30 days from the date of conclusion of the contract during or in connection with an unsolicited visit or at a sales event or in connection with it.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may withdraw from a contract concluded remotely or from a contract concluded outside the trader\u2019s business premises, the subject of which is the delivery of goods, even before the start of the withdrawal period.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may exercise the right to withdraw from a distance contract or a contract concluded outside the trader&#8217;s premises by sending an online form directly from the trader&#8217;s website, in paper form or in the form of a recording on another durable medium and, if the contract was concluded orally, any clearly formulated statement by the consumer expressing the consumer&#8217;s will to withdraw from the contract (hereinafter referred to as the &#8220;notice of withdrawal from the contract&#8221;) is sufficient to exercise the consumer&#8217;s right to withdraw from the contract.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may exercise the withdrawal from the contract in writing, by e-mail, using a sample form or via an online function available in the trader&#8217;s online interface.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If the contract was concluded via the trader&#8217;s online interface, the consumer may also withdraw from the contract by using the function marked &#8220;withdraw from the contract here&#8221;, which is available in the order details and\/or via a link sent in the confirmation e-mail.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Link to withdrawal from the contract:<\/span><\/span><\/span>\u00a0<a href=\"https:\/\/motard-design.com\/odstupenie-od-zmluvy\/\" target=\"_blank\" rel=\"noopener\">https:\/\/motard-design.com\/<span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">withdrawal-from-contract<\/span><\/span><\/span>\/<\/a><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The withdrawal period according to point 1 and paragraphs a) to b) is deemed to have been observed if the consumer sends the notice of withdrawal from the contract to the trader no later than the last day of the period.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader is obliged to provide the consumer with a confirmation of its delivery on a durable medium without delay after receiving the notice of withdrawal from the contract if the consumer withdrew from the contract using a special function or withdrawal form available in the online interface of the trader&#8217;s online store.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may withdraw from the contract only in relation to a specific product or products if the trader has supplied or provided several products on the basis of a distance contract or a contract concluded outside the trader&#8217;s premises.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">When withdrawing from a distance contract or a contract concluded outside the trader&#8217;s premises pursuant to Act No.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">108\/2024 \u00a7 19 paragraph 1, the consumer shall only bear the costs of returning the goods to the trader or to a person designated by the trader to take over the goods;<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">this does not apply if the trader has agreed to bear the costs himself.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader is obliged to return to the consumer, within 14 days from the date of receipt of the notice of withdrawal from the contract, all payments received from him on the basis of or in connection with a distance contract, a contract concluded outside the trader&#8217;s premises or a supplementary contract, including the costs of transport, delivery, postage and other costs and fees.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz JpY6Fd\"><span class=\"ryNqvb\">The trader is obliged to return to the consumer all payments pursuant to paragraph 1 to the extent corresponding to the withdrawal from the contract, if the consumer has not withdrawn from the entire distance contract or the entire contract concluded outside the trader&#8217;s premises.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader may not charge the consumer additional costs for transport, delivery, postage and other costs and fees.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader is not obliged to reimburse the consumer for additional costs if the consumer has expressly chosen a method of delivery other than the cheapest standard method of delivery offered by the trader.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Additional costs are understood to be the difference between the cost of delivery chosen by the consumer and the cost of the cheapest standard method of delivery offered by the trader.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer does not have the right to withdraw from a distance contract and from a contract concluded outside the trader&#8217;s premises, the subject of which is:<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">a) the provision of a service, if<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">1. the service has been fully provided and<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">2. the provision of the service has begun before the expiry of the withdrawal period with the consumer&#8217;s express consent and the consumer has declared that he has been duly informed that by expressing consent he loses the right to withdraw from the contract after the service has been fully provided, if under the contract the consumer is obliged to pay the price,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">b) the delivery or provision of a product the price of which depends on price movements on the financial market which the trader cannot influence and which may occur during the expiry of the withdrawal period,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">c) the delivery of goods manufactured according to the consumer&#8217;s specifications or custom-made goods, <\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">d) the delivery of goods which are subject to rapid deterioration or spoilage,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">e) the delivery of goods enclosed in protective packaging which is not suitable for return for health protection or hygiene reasons, if the protective packaging has been<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">damaged after delivery,<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">f) delivery of goods which, due to their nature, may be inseparably mixed with other goods after delivery<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">5.12 The trader provides the consumer with instructions on the exercise of the right of withdrawal from the contract as a document for download\/viewing on the website of the online store.<\/span><\/span><\/span><\/p>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6. Complaints and warranty conditions<\/span><\/span><\/span><\/h2>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.1 The handling of complaints is governed by the warranty conditions of the specific goods, the Commercial Code and the relevant provisions of the Civil Code and special regulations.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.2 The warranty period for all goods offered in the online store is 24 months with exceptions stipulated by law.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">To exercise the rights of liability for defects (complaint), proof of purchase (invoice attached) is always sufficient.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Submission of proof of purchase for the purposes of a complaint is also sufficient if a warranty certificate was issued but the consumer lost it.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.3 The warranty does not apply to normal wear and tear of the item (or its parts) caused by use, mechanical damage to the product caused by the buyer, improper handling of the product, in a manner other than that specified in the instructions for use, neglect of care and maintenance of the goods, damage to the goods by excessive loading, use of the goods in violation of the conditions specified in the documentation, general principles, technical standards or safety regulations or other violation of the warranty conditions.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Defects or damage to the product that occurred during a natural disaster are also excluded from liability.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.4 The consumer has the right to complain about a product purchased on sale or at a reduced price, however, the defect must not be related to the reason why the product was sold at a reduced price!<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.5 The consumer is obliged to deliver the claimed goods clean, mechanically undamaged, with a copy of the invoice or a copy of the receipt from the cash register for the complaint.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer is obliged to send a description of the defect along with the goods in the form provided by the trader for download at<\/span><\/span><\/span>\u00a0<a href=\"https:\/\/motard-design.com\/wp-content\/uploads\/2026\/06\/reklamacny-formular.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/motard-design.com\/<span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">complaint-form<\/span><\/span><\/span>.pdf<\/a><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.6 The trader shall handle the complaint for the goods without undue delay, but no later than 30 days from the date of delivery of the complaint to the consumer or the transport company.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">After this period has expired, the consumer has the right to withdraw from the contract or has the right to exchange the product for a new product.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">By filing a justified complaint, the warranty period is extended by the duration of the complaint.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If the complaint was settled within the statutory warranty period by exchanging the goods for a new one, then the warranty period will start again from the date of handling the complaint.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.7 CONSUMER PROCEDURE FOR COMPLAINTS: The consumer shall send the product by registered mail to the trader&#8217;s address specified in point 1 as soon as possible after discovering a defect in the product, together with a copy of the proof of purchase and a complaint protocol with a description of the product defect.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">In a situation where the goods need to be sent to the trader, the consumer shall ensure that the goods are packed in suitable packaging that will sufficiently protect the goods, meet the requirements for the transport of fragile goods and mark the shipment with the appropriate symbols.<\/span><\/span><\/span><\/p>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.8 In the event that the goods complained about were sent by post or a transport company, the transport costs associated with sending the complaint to the seller&#8217;s address shall be borne by the consumer.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The trader shall ensure that the goods complained about are sent back by post at its own expense.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Any other method of transporting the goods complained about is borne by the consumer at the express request of the consumer.<\/span><\/span><\/span><\/p>\n<p class=\"md-point\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">6.9 The complaint shall be considered settled when the product is handed over to the consumer after repair, exchange or rejection of the complaint, or a refund upon withdrawal from the contract.<\/span><\/span><\/span><\/p>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">7. Information on alternative dispute resolution<\/span><\/span><\/span><\/h2>\n<p><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If the consumer is not satisfied with the way in which the trader has handled his complaint or if he believes that the trader has violated his rights, he has the option of contacting the trader with a request for redress.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">If the trader responds negatively to the request for redress or does not respond to it within 30 days of its sending, the consumer has the right to submit a proposal to initiate alternative dispute resolution of his dispute pursuant to the provisions of Section 12 of Act No. 391\/2015 Coll.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">on alternative dispute resolution of consumer disputes and on amendments and supplements to certain acts.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The competent entity for alternative dispute resolution of consumer disputes with the trader is, for example, the Slovak Trade Inspection &#8211; Inspectorate of the SOI for the Tren\u010d\u00edn Region, Hurbanova 59, 911 01 Tren\u010d\u00edn, Department of Supervision, tel.<\/span><\/span> <span class=\"jCAhz\"><span class=\"ryNqvb\">no.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">032\/640 01 09,<\/span><\/span><\/span> <a href=\"http:\/\/www.soi.sk\" target=\"_blank\" rel=\"noopener\">http:\/\/www.soi.sk<\/a> <span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">or another relevant authorized legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at<\/span><\/span><\/span> <a href=\"http:\/\/www.mhsr.sk\" target=\"_blank\" rel=\"noopener\">http:\/\/www.mhsr.sk ,<\/a> <span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">the consumer has the right to choose which of the listed alternative dispute resolution entities to contact.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Consumers have the option of using the online dispute resolution platform (hereinafter referred to as the \u201cODR\u201d) to resolve their disputes, in the language of their choice.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may use the ODR platform for alternative dispute resolution, which is available on the website<a tabindex=\"-1\" href=\"https:\/\/consumer-redress.ec.europa.eu\/site-relocation_en\" target=\"_blank\" rel=\"noopener\"> consumer-redress.ec.europa.eu\/site-relocation_en<\/a><\/span><\/span><\/span><\/p>\n<div class=\"lRu31\" dir=\"ltr\"><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">When submitting a submission on the ODR platform, the consumer shall fill in an electronic complaint form.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The information submitted must be sufficient to identify the relevant online alternative dispute resolution entity.<\/span><\/span> <span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">The consumer may attach documents to support his complaint.<\/span><\/span><\/span><\/div>\n<h2><span class=\"HwtZe\" lang=\"en\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">8.
